Newport News School Bus Crash Sends Student to Hospital

York County, VA Crash Leaves Unrestrained Children Badly Injured

Newport News, VA Intersection Identified as Most Dangerous in Hampton Roads

During 2008 the junction of the J. Clyde Morris Boulevard and Jefferson Avenue was the site of 63 traffic accidents.

The draft 2011 update to the Hampton Roads Regional Safety Study: General Crash Data and Trends highlights the J. Clyde Morris Boulevard and Jefferson Avenue intersection in Newport News, Virginia (VA) as the most dangerous in Hampton Roads. During 2008, the junction was the site of 63 traffic accidents, while overall, a crash occurred every 23 minutes in crashes in Hampton, Newport News, Suffolk, Norfolk, Chesapeake, Portsmouth, Norfolk and Virginia Beach.

“Other problematic intersections on the Peninsula included Big Bethel Road and Hampton Roads Center Parkway; Armistead Avenue and Mercury Boulevard; and Cunningham Avenue and Mercury Boulevard,” the Daily Press reported.

While the sheer number of crashes in the city is declining, there is no evidence that drivers are being as careful as they could be. In some cases, alcohol was to blame for collisions. In the summer of 2011, a teacher was left with long-term care needs after being hit by a 17-year-old who was charged with DUI. Also in June 2011, two tow truck drivers were killed in Newport News when one truck ran into the other on the shoulder of the I-64. Also, in just one week of October 2011, two school buses were involved in accidents in Newport News.

Two Boat Operators Charged in Collision That Killed Gloucester Teen

A Sea Tow operator and the father of the teenager are awaiting trial on charges of involuntary manslaughter.

Almost exactly a year after the operator of Sea Tow rescue boat collided with a small fishing boat under the James River Bridge between Carrolton and Newport News, Virginia (VA), killing a 13-year-old boy, the U.S. Coast Guard announced on October 31, 2011, that it had officially suspended the commercial boating license of the tow boat operator.

Coast Guard investigators determined that both the Sea Tow and the fishing boat were speeding at the time of the fatal crash and that neither boater was maintaining a proper lookout for other vessels or hazards to navigation. “The simple precaution of reducing speed when operating in the vicinity of the James River Bridge could have prevented this tragic accident,” said Cmdr. Jerry Barnes, the chief of the prevention department at Coast Guard Sector Hampton Roads said in a press release.

Both the Sea Tow operator and the father of the teenager are awaiting trial on charges of involuntary manslaughter. So, in essence, this accident and its pending outcome could not be sadder or more of a loss for everyone involved. A  teen died before he really had a chance to live, a father lost his son and may serve prison time as a result, and a professional boater has lost his livelihood and, possibly, his freedom.

If there can be any positive result from the deadly boat crash, I hope it will be that all who read or hear about it realize that boating can be as, or more, dangerous as driving a car or truck and take all necessary safety precautions to prevent tragedies on the water.

Two School Bus Wrecks in One Week in Newport News

On October 19, 2011, a bus driver passed out and drove off the road. Six days later, a red light runner drove into a Hampton City bus, injuring a bus aide.

Continuing what appears to be a dangerous trend for students in Hampton Roads, two school buses were involved in traffic accidents in Newport News, Virginia (VA), in a single week. On October 19, 2011, a bus carrying five children ran off Woodside Lane and hit a tree when its drive lost consciousness. The Daily Press reported that no one suffered injuries and that police and school officials believed a “medical emergency” caused the driver to lose control of the bus.

The situation and results were more serious when a man driving a Mustang ran a red light at the intersection of Jefferson Avenue and Fort Eusts Boulevard and struck a Hampton City Public Schools bus that had just dropped off students at the New Horizons Regional Education Centers. A bus aide received hospital treatment for a minor injury to her midsection, according to WAVY-TV 10.

Also on October 25, a bus taking 43 children home from Cedar Road Elementary School in Chesapeake, VA, was cut off by a car and ended up wrecked. One child aboard the bus and a passenger in the car suffered injuries.

None of the three bus crashes resulted in serious injuries or, thankfully, deaths, but each can teach important lessons about how to keep children and teens safe as they travel to and from school. First, any driver, especially a person responsible for the lives and health of dozen of kids, must be sure he or she is healthy enough to operate a vehicle and respond quickly and appropriately to changing road conditions.

Second, no one should ever run a red light or ignore a stop sign. There is no excuse for being so distracted or so impatient that you don’t obey traffic signals.

Last, cars, trucks, SUVs and motorcycles must yield right of way to school buses. Let buses pass before merging, turning or changing lanes. Also, always stop, in both directions, when a bus has halted to take on or let off students.

Newport News, Virginia (VA) Man Killed by Norfolk Southern Train

In 1883, the first carload of coal to Norfolk, Virginia (VA) arrived by rail.  By 1900, Norfolk was the leading coal exporting port on the East Coast – and the industry has continued to grow ever since.  However the financial incentives that the area receives from the railroad industry are often shadowed by the loss of life and railroad injuries that inevitably occur.

New Road in Newport News Would Connect Major Streets

The four-lane highway called Atkinson Way would link Warwick Boulevard to Jefferson Avenue between Richneck Road and Ford Eustis Boulevard.

An idea for a new four-lane highway called Atkinson Way that would link Warwick Boulevard to Jefferson Avenue between Richneck Road and Ford Eustis Boulevard in Newport News, Virginia (VA), is on it’s way to becoming a reality after the Hampton Roads Transportation Planning Organization approved funding towards the project. City Manager Neil Morgan told the Daily Press that he expects the city to contribute $10 million to the estimated $52 million project. If City Council approves the funding request, the project could begin in 2012. Still, don’t expect to be seeing the road any time too soon – experts project a finish date of 2017 or 2018.

The planned road would be bordered by sidewalks and feature bridges over I-64 and the railroad tracks. Ultimately, it would alleviate traffic on Warwick and Jefferson, a major concern for citizens after Fort Eustis expanded its workforce when it consolidated operations with Langley.

As a Newport News car accident attorney, learning of this new road is certainly exciting. New roads, especially ones that prevent excessive traffic, are good news for just about everyone. Less traffic almost always means fewer accidents. With sidewalks and a bridge over 1-64, this road could also mean safer travel for pedestrians and bicyclists. Atkinson Boulevard is still in the planning stages, of course, but it’s easy to see just how necessary a new road is.

Another Newport News House Hit by Out-of-Control Car, Five Injured

For the second time in a week, a family in Newport News, Virginia (VA), received a rude awakening when a car ran off the road and crashed into their house. The first accident occurred around 6:30 am on October 12, 2011, when two cars collided on Colony Road and one of the vehicles wound up in the living room of nearby home. Both drivers sustained injuries in that wreck, but no one inside the house was hurt.

The people involved in a similar incident near the intersection of 41st Street and Chestnut Avenue on October 19 at 8:30 am were not as fortunate. Two children in the house, two child passengers in the car and the car’s driver all had to go for the hospital for treatment and observation. The man who owns the house told WAVY-TV 10 that he and his family had narrowly escaped injury a few days earlier when a motorcycle crashed through a fence on the property.

As a Virginia persona injury attorney, I know that any time a drive loses control of his or her vehicle and runs off the road, injuries and even deaths are strong possibilities. Pedestrians and, as the recent wrecks in Newport News show, people in building in the paths of careening cars are sitting ducks. I wish speedy recoveries for all the people hurt in the crashes.

My colleague John Cooper has written about a pedestrian’s death that occurred at the train tracks between 23rd Street and Granby Street in Norfolk, Virginia (VA). The body of a 26-year-old Newport News resident was discovered on October 13, 2011, and police are trying to determine whether the man was hit and killed by a Norfolk Southern coal train. Marine Loses Life When Struck by Car on Yorktown, VA Naval Base

Car Hits Marines, Kills One and Injures Several at Naval Weapons Station Yorktown

A car accident on base at the Naval Weapons Station Yorktown in Virginia (VA) has left one Marine dead, two Marines hospitalized and several active duty military members nursing minor injuries such as scrapes and bruises. The wreck, in which the car’s driver plowed into a formation run of members of the 2nd Fleet Anti-Terrorism Security Team Company (FAST), Marine Security Force Regiment also has raised many questions.

The Navy has released few details about the incident, but the Naval Criminal Investigative Services is working to determine how a driver could fail to see and avoid hitting a group of at least 50 Marines who were closely grouped and all wearing reflective belts to increase their visibility as they participated in physical training shortly before 7 am on October 11, 2011.

Low visibility for the at-fault driver certainly seems a possible explanation. But as with two recent pedestrian fatalities in Chesapeake, VA, that occurred, respectively, in the early morning and shortly after sunset, claiming “I couldn’t see clearly” would not absolve the driver of civil liability for the death and injuries caused.

Distraction also has to be strongly considered. Even though Virginia law and federal regulations prohibit using cell phones and other handheld devices while driving, those rules are often violated with tragic consequences.

Drunk or drugged driving can also not be immediately ruled out. Impairing alcohol and drugs can remain in a person’s system for long periods, making it just as dangerous to get behind the wheel six hours after the last drink or dose as it would have been earlier.

Regardless of the cause, I offer my sympathies to the friends and family of the Marine who lost his life in this unforeseeable accident, along with my hopes for speedy recoveries for the service members who were injured.

Vehicle Crashes Into Newport News Home

Imagine waking up, pouring yourself a cup of coffee, and having a car slam through your front window. That was the reality for a Newport News family after a car crashed into a home at approximately 6:42 am on October 12, 2011.

The driver of a Volkswagen sedan struck a Mazda sedan at the corner of Colony and Marlboro roads. The driver of the Volkswagen lost control of the vehicle, went off the road and struck the home. The car eventually came to a stop by resting against a tree.

The driver of the Mazda was taken to the hospital with injuries, and the driver of the Volkswagen was treated at the scene of the accident for injuries. Thankfully, no one in the house was injured.

I can only imagine how terrified the people inside the house must have been to realize a car accident was spinning toward their home. We all see our homes as safe havens, especially early in the morning when the day is just beginning. No one could ever expect something like this to happen.

Authorities are still investigating this accident, but as a Newport News car accident attorney, I can’t help but speculate about why this crash might have occurred. Early in the day, drivers are sometimes sleepy and not as alert behind the wheel as they could be. Thankfully, the early hour meant fewer cars on the road. I can only imagine how much more dangerous this crash might have been had there been more traffic down Colony Road.
